List of Pfandbrief banks within the meaning of section 2 paragraph 6 of the German Pfandbrief Act
BaFin, by way of section 2 paragraph 6 of the German Pfandbrief Act, is mandated to publish a list of credit institutions permitted to carry out Pfandbrief business within the meaning of section 1 paragraph 1, second sentence of the German Pfandbrief Act. In addition, in that list have to be included information on the scope of permission (by type of Pfandbriefe), the date the permission was granted, as well as the information for which type of Pfandbrief of the respective Pfandbrief bank which of the designations provided in section 41a of the German Pfandbrief Act [i.e. the “labels” ‘European Covered Bond’ or ‘European Covered Bond (Premium)’] may be used.
This list does not comprimes types of Pfandbriefe, for which the permission to carry out Pfandbrief business has ended (or, more precisely, has changed into a winding down-permission), e.g. by way of the Pfandbrief bank’s renunciation of the permission for a given type of Pfandbriefe, and which therefore merely are to be wound down.
The publication is meant to provide easier access for market participants to the Pfandbrief-related information included in the list. This list is to be updated at least on a quarterly basis.
