On the basis of section 19 (5) in conjunction with subsections (1) and (3) of the German Payment Accounts Act of 11 April 2016 (Federal Law Gazette I, p. 720), as most recently amended by Article 26 no. 6 of the Act of 11 December 2023 (Federal Law Gazette 2023 I No. 354) in conjunction with section 1f of the Regulation on the Transfer of Powers to Issue Statutory Orders to the Federal Financial Supervisory Authority of 13 December 2002 (Federal Law Gazette 2003 I p. 3), which was inserted by Article 2 of the Regulation of 24 January 2024 (Federal Law Gazette 2024 I No. 21), the Federal Financial Supervisory Authority issues the following Regulation in consultation with the Federal Ministry of Finance, the Federal Ministry of Justice and the Federal Ministry for the Environment, Nature Conservation, Nuclear Safety and Consumer Protection:
Section 1
Subject matter of Regulation
This Regulation governs
- reporting data for the comparison website in accordance with the Payment Accounts Act and
- clarifying and supplementing the comparison criteria.
Section 2
Data to be reported
(1) The reporting requirement under section 17 (2) of the Payment Accounts Act comprises the following data for each payment account offered to consumers by a payment service provider:
- the name of the payment service provider,
- details of the name under which the payment service provider or the branch of the payment service provider offers the payment account,
- the website of the payment service provider,
- contact information for a consumer report to the payment service provider,
- the product name of the payment account,
- the date of the report and
- the comparison criteria specified in the Appendix and the data to be reported for these comparison criteria in accordance with the Appendix.
(2) The reporting requirement under section 17 (2) sentences 2 and 3 of the Payment Accounts Act also includes reporting data to correct incorrectly reported data.
Section 3
Deadline for initial implementation of the reporting requirement.
The first report in accordance with section 17 (2) sentence 1 of the Payment Accounts Act in conjunction with section 2 must be submitted between 1 September 2024 and 30 September 2024.
Section 4
Format for the report
(1) The payment service provider must summarise all data on the payment accounts it offers that it is required to report in accordance with section 17 (2) sentence 1 of the Payment Accounts Act in conjunction with section 2 in a uniform and complete data set. The following must also be summarised in a uniform and complete data set:
- the reports in accordance with section 17 (2) sentences 2 and 3 of the Payment Accounts Act in conjunction with section 2 and,
- the reports correcting incorrectly reported data displayed on the comparison website,
(2) The report must be submitted electronically using the reporting platform of the Federal Financial Supervisory Authority. The specialised procedure provided for this purpose must be used for the report.
Section 5
Correct data transmission
(1) The payment service provider must ensure that the data for the report is transmitted correctly.
(2) The Federal Financial Supervisory Authority will publish information and guidance for the proper transmission of data on the reporting platform and on its website
- for the report,
- for the electronic submission method,
- for the data formats to be used for the report and
- for the data to be reported in accordance with section 2.
(3) The payment service provider must comply with the information and guidance published by the Federal Financial Supervisory Authority. It may not transmit any data other than the data to be reported in accordance with section 2.
Section 6
Entry into force
This Regulation enters into force on the day following its promulgation.
